In September of 1977 William Dale Snyder, defendant-appellant Robert A. McWhorter, and others were attempting to obtain financing for a trip to South America to purchase cocaine and marijuana. Snyder contacted Special Agent Jerome Mattioli of the Federal Drug Enforcement Administration Snyder believed that Mattioli was Matt Rosetti, a Detroit loanshark. During the taped conversation Snyder stated that he hoped Mattioli would finance a scheme to import cocaine and marijuana which he and others had agreed to obtain from South America. Mattioli was told that he would need to talk to "the one who is in the know", an attorney from Kalamazoo, Michigan. The attorney referred to in the conversation was defendant-appellant McWhorter.
